THE PEOPLE, Plaintiff and Respondent, v. ALLEN EUGENE REED, Defendant and Appellant.

Court of Appeals of California, Appellate Department, Superior Court, Los Angeles.

October 31, 1980.

Attorney(s) appearing for the Case

COUNSEL

Thomas F. Coleman for Defendant and Appellant.

John K. Van de Kamp, District Attorney, Donald J. Kaplan and Dirk L. Hudson, Deputy District Attorneys, for Plaintiff and Respondent.

OPINION

SAETA, J.

Defendant was convicted of engaging in lewd conduct in violation of Penal Code section 647, subdivision (a) on the testimony of an officer that he observed defendant masturbating in a public restroom. He attacks the sufficiency of that evidence by attacking the proof on the element of the offense articulated in Pryor v. Municipal Court (1979)
