In January, 1976, the defendant, Juan Pagan, was tried on an indictment charging him with unlawful distribution of heroin. The jury returned a verdict of guilty; and the judge sentenced the defendant to a term of not less than six nor more than ten years at the Massachusetts Correctional Institution at Walpole.
