The defendant, Blake Loveless, was charged by indictment with the offense of unlawful possession of cannabis in violation of section 4(d) of the Cannabis Control Act (Ill. Rev. Stat. 1975, ch. 56 1/2, par. 704(d)). Prior to trial the defendant moved to suppress the cannabis seized on the grounds that it had been obtained as a result of an illegal seizure.
