ROBERT L. TAYLOR, District Judge.

This is a breach of contract case. Plaintiff claims $45,623.49 in penalties by reason of defendant's alleged failure to deliver to plaintiff coal of the proper BTU value as provided for in the contract. The case was referred to a Special Master, who, having heard proof, has recommended that the Court enter judgment in favor of plaintiff for $45,623.49.
