OPINION OF THE COURT

O'BRIEN, Justice.

Appellant, Jack Bestwick, was convicted by a jury of macing. Post-verdict motions were denied and appellant was sentenced to pay a fine of $300 and a prison term of three months to one year. The Superior Court affirmed by an equally divided court. Commonwealth v. Bestwick, 262 Pa.Super. 558, 396 A.2d 1311
