This is an appeal from a judgment of the Montgomery Circuit Court, denying appellant's petition for post-conviction relief. Appellant Lutes was charged in Montgomery Circuit Court with kidnapping. Pursuant to a plea agreement, Lutes pleaded guilty to the amended charge of commission of a felony while armed, to-wit: rape, in exchange for a dismissal of the kidnapping charge.
