Plaintiff brought this case against defendant Citizens Bank and defendant Hollis Q. Lathem, under the court's diversity jurisdiction. 28 U.S.C. § 1332. In June, 1977, plaintiff received five checks, each in the amount of $20,000.00 drawn on the account of Tress Enterprises, Inc., with defendant Citizens.
