This is an appeal by the defendant from a conviction of theft in the second degree, a misdemeanor, under HRS § 708-832.

On July 17, 1977, the defendant was apprehended in the garage area of a Manoa home and arrested for theft in the second degree. Also arrested was one Gary Miyamoto from whose car items belonging to the victim were recovered.
