The present appeal is one phase of a landlord-tenant dispute to which the parties have devoted an extraordinary amount of their time and efforts and those of several courts.1 The major questions on this appeal involve the tenant's claims for damages under the Residential Landlord and Tenant Act, ORS 91.700 to 91.895, and under tort law.
