On April 27, 1976, defendant Larry Walker, a police officer of the City of Hudson, obtained an accusatory instrument charging plaintiff with selling a controlled substance in the fifth degree, in violation of subdivision 1 of section 220.34 of the Penal Law. The accusatory instrument was predicated upon the sworn deposition of Calvin Hester, an informer, which stated that plaintiff had sold him $5 worth of marihuana.
