OVERTON, Justice.

The petition for writ of certiorari reflected apparent jurisdiction in this Court. We issued the writ, received briefs on the merits, and heard argument of the parties. For the reasons expressed, we have determined that the order of the First District Court of Appeal granting a motion to dismiss presents no conflict with Bert Rodgers Schools of Real Estate v. Florida Real Estate Commission, 339 So.2d 226
