Petitioner is now confined to the Fishkill Correctional Facility, New York State, serving a sentence of two to four years pursuant to a judgment of conviction, entered upon a jury verdict, of the crime of attempted burglary in the third degree. The same jury also found him guilty of the crimes of possession of burglar's tools and criminal mischief in the fourth degree...
