This is a direct appeal filed by Charles E. Henderson, who was found guilty by a jury of murder in the second degree, K.S.A. 21-3402, and felony theft, K.S.A. 21-3701. He was sentenced to imprisonment for not less than five years nor more than life for the homicide and not less than one nor more than ten years for felony theft, the sentences to run concurrently.
