THOMPSON, J., delivered the opinion of the Court.

On the evening of December 12, 1977, shortly after 11:00 p.m. Trooper Greg Presbury of the Maryland State Police stopped David Albert Pfeiffer, the appellant, on Maryland Route 3 in Anne Arundel County. Presbury was shot and later died from his wounds and appellant was also shot.
