On April 6, 1975, after trial by jury in the Circuit Court of Scott County, movant was convicted of murder in the second degree and, in conformance with the jury verdict, was sentenced to a term of 10 years in the Missouri Department of Corrections. Movant did not appeal that judgment and sentence. On November 17, 1976, movant filed a motion in the trial court to vacate the judgment and sentence, pursuant to Rule 27.26, V.A.M.R.
