Plaintiff Horace Tuseth was involved in a single vehicle accident on Minnesota Highway Nine, near Crookston, which was then being resurfaced by defendant Thoreson, Inc. Plaintiff was the driver and sole occupant of a pickup truck that left the road while negotiating a level, gradual curve.
