This appeal is taken from an order of the Circuit Court of Butler County dismissing the appeal of Enoch Ray Maxey from an order of the Probate Court of Butler County. The appeal reached this court by the following route: E. E. Maxey died intestate on April 19, 1976; he left surviving a widow, Edna, and two sons, Erney, Jr., and Enoch Ray.
