On October 22, 1976, Joseph Manuel Da-Rocha (Manuel) and his brother Joseph Louis DaRocha (Louis) were convicted of second-degree murder in a Superior Court jury trial. On appeal they argue that the trial justice failed to assess independently the credibility of the state's witnesses in ruling on, and denying, their motion for a new trial.
