SMITH, J., delivered the opinion of the Court.

This is yet another law suit which stems from the tremendous building expansion on Maryland's bit of seashore since World War II.1 This controversy grows out of a joint venture to construct a motel in Ocean City, said to have been intended as a Holiday Inn. Before work on the foundation was completed certain of the joint venturers withdrew.
