Appellant, Clarence Starks, was tried by a judge sitting with a jury in connection with the homicide of Jeremiah Middleton. The homicide occurred on January 25, 1974. The jury returned a verdict of murder of the first degree, criminal conspiracy, carrying a firearm on a public street or public property and unlawfully carrying a firearm without a license.
