Defendant was indicted for the crime of assault in the first degree allegedly committed on his 10-week-old son. After a denial by the trial court to suppress certain testimony relating to statements made by defendant to two social workers, he pleaded guilty to assault in the second degree and was sentenced to one year in the Albany County Jail.
