Appellant was by the verdict of a jury convicted of the commission of the crime under § 557.215, RSMo 1969, of willfully wounding a police officer who was allegedly "actively engaged in the performance of duties imposed upon him by law." Appellant was sentenced to three years imprisonment in the Division of Corrections, but the court granted him probation for a five year period.
