The issue presented on appeal is the constitutionality of that portion of sec. 71.09(7) (b), Stats., which provides that "the right to file claim [for homestead credit] ... shall be personal to the claimant and shall not survive his death."1

The facts are uncontested. Bergliot G. Bonneville suffered a stroke on November 18, 1974; she died on January 6, 1975....
