Despite more than five years of People v Sandoval (34 N.Y.2d 371) and its progeny, no reported decision has yet set forth a fair compromise that can actually minimize prejudice to the defendant while simultaneously protecting the interests of the People. I now propose to attempt to rectify that situation.
