THOMPSON, Justice:

A jury convicted Levi of child abuse resulting in substantial bodily harm.1 The legislature has defined substantial bodily harm for the purposes of criminal penalty as meaning (1) bodily injury which creates a substantial risk of death, or which causes serious, permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ, or (2) prolonged physical pain.
