The appellant, Ralph Lee Todd, was indicted on October 1, 1976, for the murder of Blair Thomas. He was tried by a jury and found guilty; the state had sought the death penalty, but because the jury was unable to reach a verdict as to sentence, the trial court sentenced him to life imprisonment.1
