Appellee Tibbs' original conviction for rape and first-degree murder was reversed for a new trial by the Supreme Court of Florida. Tibbs v. State, 337 So.2d 788 (Fla. 1976). On remand the trial court concluded that to retry Tibbs would violate the double jeopardy clause of the fifth amendment to the United States Constitution and, therefore, granted his motion to dismiss the indictment against him.
