On December 3, 1977, defendant arrived at the 284 Club, a bar in the Village of Massena, New York, at approximately 2:00 P.M. and drank until about 6:30 P.M., when the bartender, John Carroll, refused to serve him any more drinks because of his annoying behavior involving a waitress.
