OPINION

PHILLIPS, Judge.

This is an appeal from an order of the trial court that the appellant be held without bail pending his appeal to this Court from a conviction for the offense of theft, in accordance with Article 44.04(c), V.A.C. C.P.

On December 16, 1978, the appellant was convicted of theft by a jury upon his plea of not guilty. Punishment was assessed by the jury at 15 years. On January 5, 1979, the appellant was sentenced. At that time...
