Appellant Sam Goldman appeals from a judgment entered by the District Court for the Eastern District of Missouri1 in favor of appellee Merrill Lynch, Pierce, Fenner & Smith, Inc. (hereinafter Merrill Lynch). Merrill Lynch initiated the action to recover an alleged deficiency of $119,145.00 in appellant's commodities margin trading account.2
