On March 6, 1979, defendant was arrested for violation of section 4941(a) of the Vehicle Code, 75 Pa.C.S.A. §4941, by the operation of a tri-axle dump truck loaded with coal having a weight of 85,430 pounds when the allowable weight under the act is 73,280 pounds.
