STAPLETON, District Judge:

This is a civil rights action brought pursuant to 42 U.S.C. § 1983. The plaintiff, Gilbert Hawkins, was employed by the Board of Public Education of Wilmington ("Board of Education"), and held the position of Fireman Custodian at Bayard Middle School ("Bayard School") since 1969.
