This is an appeal from a summary judgment granted by the Circuit Court of Hale County. We affirm.

Grover S. Nevin died testate in 1954, survived by his widow, Ila J. Nevin, and four children, Grover A., Julia, Cecil, and Marie. When he died, Nevin owned several parcels of real estate situated in Hale and Tuscaloosa Counties.
