David G. Flemming had been indicted in Aroostook County on two charges of murder and had pleaded not guilty and not guilty by reason of mental disease to both charges. After a full trial before a single justice of the Superior Court, a verdict and judgment were entered acquitting Flemming of the two charges "by reason of mental disease excluding responsibility." 15 M.R.S.A. § 103.
