Appellant John Henry Mooney was indicted with Elmo Florence for the murder of T. K. Harty. He was tried separately, and was convicted by a jury and sentenced to life imprisonment on May 2, 1978. He brings this appeal.

The trial evidence showed that on August 30, 1977, the body of Harty, the owner of a saloon in Athens, Georgia, was discovered slumped over a desk in his home. He had been shot once in the back of the head, apparently during the...
