William J. Straughan, defendant below, appeals from the granting of motions for summary judgment and for severance filed by Houston Citizens Bank & Trust Company in a suit on a promissory note. Straughan had filed a cross-action alleging that the bank had withdrawn funds from his account without authorization and praying for an accounting. He says the trial court erred in granting summary judgment because the original promissory note was not introduced...
