This is an action for malicious prosecution growing out of charges filed against the plaintiff for misdemeanor theft.

On January 29, 1974, the plaintiff John Henry Eans was working as an employee of Grocers Supply, Co., Inc., a wholesale food supplier, at its frozen food locker.
