The plaintiff, New York Yellow Pages, Inc. [hereinafter referred to as "the Yellow Pages"], commenced this action against the defendant, Citibank, N.A. [hereinafter referred to as "Citibank"], in August, 1978, alleging trademark infringement and unfair competition.
