Appellant, James R. Maclin, was convicted in a jury trial of rape, Ind. Code § 35-13-4-3 (Burns Code Edition) since repealed effective October 1, 1977, and kidnapping, Ind. Code § 35-1-55-1 (Burns Code Edition) since repealed effective October 1, 1977. He was sentenced to twenty-one years and life imprisonment.
