CONNER, District Judge:

This is a petition for a writ of habeas corpus brought pursuant to 28 U.S.C. § 2254.

Petitioner is presently confined at Woodbourne Correctional Facility pursuant to a judgment of conviction rendered on August 9, 1974 in the Monroe County Court convicting him, following a jury trial, of attempted first-degree robbery, possession of weapons and reckless endangerment in the first degree.
