PIVARNIK, Justice.

Appellant James R. Norris was convicted by a jury in the Rush Circuit Court on March 23, 1976, of theft, Ind. Code (Burns 1975) § 35-17-5-3, and of being a habitual criminal, Ind. Code (Burns 1975) § 35-8-8-1. He received an indeterminate sentence of one to ten years on the theft count and a life sentence on the habitual criminal count.
