This case comes to this Court on appeal from the denial of petitioner's petition for writ of habeas corpus, treated and decided in the Madison Circuit Court as a petition for post-conviction relief. The petitioner Buford Ray Lipps, had been convicted of inflicting injury while attempting robbery, Ind. Code § 35-13-4-6 (Burns 1975), and was sentenced to life imprisonment on December 22, 1966.
