Appellant George Onwukwe seeks review of the trial court's judgment dismissing his action against Kroger Company (Kroger) for malicious prosecution.

It is uncontested that on June 12, 1977 and July 4, 1977 Mr. Onwukwe made checks to Kroger that were returned for insufficient funds. On July 25, 1977, Mr. Onwukwe received notice from Kroger by certified mail that these checks had been returned unpaid, along with a request for payment. Payment...
