The sole issue in this appeal involves the determination by the trial judge that the refusal of the employer to pay workman's compensation benefits was not arbitrary, capricious, or without probable cause.

The facts are as follows: Melvina Bryant, appellant, was employed as a bus driver for New Orleans Public Service, Inc., the appellee. On May 25, 1975, Mrs. Bryant slipped getting out of the driver's seat of her bus injuring her back. NOPSI...
