On September 9, 1977, Kennard Carzoli was stopped for speeding near Moses Lake, Washington, by Trooper Butler of the Washington State Patrol. Observing several beer cans in the back seat, and detecting a "strong odor of intoxicants," Butler had Carzoli, age 20, perform several physical sobriety tests which he failed.
