The question before us stems from a challenge to this court's summary jurisdiction. Specifically the issue is whether the debtor in possession can bring an adversary proceeding in the bankruptcy court to recover money allegedly misappropriated by the defendants (the former General Partner and Managing Agent of the debtor) prior to the filing of the Chapter XII case. We conclude that the court does not have jurisdiction...
