Defendant was indicted for two counts of aggravated assault in that he did on a certain date unlawfully commit an assault upon two separate persons by shooting them with a pistol. He was then tried and convicted on November 9, 1978, as to Count 1, the jury finding him not guilty as to Count 2. He was sentenced to serve five years.
