Defendant was indicted for two counts of aggravated assault in that he did on a certain date unlawfully commit an assault upon two separate persons by shooting them with a pistol. He was then tried and convicted on November 9, 1978, as to Count 1, the jury finding him not guilty as to Count 2. He was sentenced to serve five years. On February 28, 1979, the trial court denied defendant's motion for new trial, as amended. Defendant appeals...
