1. The defendant did not deny that he shot and wounded the victim. He, his girl friend, the victim, and two disinterested witnesses who were present in the store testified, and the only serious conflict is whether, as the defendant was at the door with his back to the victim, the victim seized the defendant and pitched him into the door, or whether he merely tapped him on the back and said something about not fighting.
