This action is brought under the Federal Employers' Liability Act (FELA), 45 U.S. C.A., §§ 51-60, to recover damages sustained as a result of the injury and death of Earl W. Nesler, a carman employed by the Chicago, Rock Island and Pacific Railroad Company (Railroad). The matter was tried in Freeborn County District Court. By special verdict the jury found that the Railroad and Nesler were each 50 percent negligent and that Nesler's widow...
