ROUSE, J.

Defendant, David Barker, was charged by information with three felony violations of section 187 of the Penal Code: the murders of Floyd Braeseke, his wife, Barbara Braeseke, and Floyd's father, John Braeseke, all in the same incident on August 23, 1976, in Alameda County, California. He entered a plea of not guilty to all three counts. A jury found him guilty of two counts of second degree murder for the killings...
